Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website helpmyboyfriend.com, our progressive web application, and any related services (collectively, the “Service”) operated by Help My Boyfriend (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

Your Account

To access premium features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account.
• Promptly notify us of any unauthorised access or use of your account.
• Accept responsibility for all activities that occur under your account.

You may not share your account credentials, create multiple accounts to circumvent rate limits, or use another person’s account without their permission.

Subscription & Billing

The Service offers a free tier with limited functionality and paid subscription plans (monthly at $9.99 or annual at $79). Subscription details:

• Auto-renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current price unless cancelled before renewal.
• Payment processing. All payments are processed by Stripe. Your card is charged immediately upon subscription and at each renewal.
• Price changes. We may change subscription prices with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
• Taxes. Prices do not include applicable taxes which will be added at checkout where required by law.
• Failed payments. If a payment fails, we will attempt to charge your card again. After repeated failures your subscription will be suspended.

Refunds & Cancellation

Cancellation: You may cancel your subscription at any time from the Account page. Cancellation takes effect at the end of the current billing period; you retain Premium access until then.

Refunds beyond 7 days: We do not provide refunds for partial billing periods, unused features, or after the initial 7-day window except where required by applicable law.

To request a refund, email hello@helpmyboyfriend.com with your account email and we will process it within 5 business days.

Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable law or regulation.
• Harass, threaten, deceive, defame, or stalk any person.
• Engage in non-consensual surveillance of any individual, including your partner.
• Scrape, copy, or harvest data from the Service through automated means.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code.
• Interfere with the security or integrity of the Service.
• Resell, redistribute, or otherwise commercialise the Service or its content.
• Create accounts using false information or impersonate any person.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice and without refund.

Content & Disclaimers

The Service provides ideas, suggestions, and recommendations related to relationships, dating, gifts, and personal development. Please understand:

• Not professional advice. Content on the Service is for informational and entertainment purposes only. It does not constitute professional therapy, counselling, legal, medical, or financial advice.
• Your judgment required. You are solely responsible for how you apply suggestions in your own relationship. Every relationship is different; what works for some may not work for others.
• Third-party data. Restaurant listings, venue information, ratings, and similar data come from third parties (e.g., Google Places). We do not verify accuracy and disclaim responsibility for errors.
• No guaranteed outcomes. We make no promises that using the Service will improve your relationship, save your marriage, or produce any specific result.
• Crisis situations. If you or your partner is experiencing abuse, threats of harm, or a mental health crisis, please contact qualified emergency services or a licensed professional. The Service is not a substitute for crisis intervention.

Intellectual Property

All content on the Service — including text, design, graphics, logos, icons, and software — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.

Third-Party Services

The Service integrates with third-party services including Stripe (payments), Netlify (hosting and authentication), Google Places (venue data), Amazon Associates (product links), OpenTable and Resy (restaurant booking links), and Open-Meteo (weather data).

Your use of these third-party services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services and disclaim liability for any actions, content, or data of third parties.

Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill arising from your use of the Service.
• Our total liability for any claims relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental damages, so the above limitations may not fully apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Help My Boyfriend, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

You may terminate your account at any time by cancelling your subscription and deleting your account from the Account page.

We may suspend or terminate your access immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases. Sections governing intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated by updating the “Last updated” date and, where appropriate, by email or in-app notification.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in New Jersey, except where you have a right to bring a claim in small claims court or where applicable consumer protection laws require otherwise.

You waive any right to a class action against us. Disputes will be resolved on an individual basis only.
